Welcome to Iconic Climbs. The terms “we,” “us,” and “our” refer to Iconic Climbs, a brand owned and operated by Coastal Design Collective LLC. Iconic Climbs operates this store and website, including all related information, content, features, tools, products, and services (the “Services”). Iconic Climbs is powered by Shopify, which enables us to provide the Services to you.
These Terms of Service (the “Terms”), together with any policies referenced herein (including our Privacy Policy and Shipping & Returns Policy), describe your rights and responsibilities when you use the Services.
By visiting, interacting with, or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you should not use or access our Services.
SECTION 1 - ACCESS AND ACCOUNT
By agreeing to these Terms, you represent that you are at least the age of majority in your state or province of residence. You also represent that you have given us your consent to allow any of your minor dependents to use the Services on devices you own, purchase, or manage.
To use the Services—including browsing, creating an account, or purchasing—you may be asked to provide certain information, such as your email address, billing, payment, and shipping details. You represent that all information you provide is accurate, current, and complete, and that you have all rights necessary to provide it.
You are solely responsible for maintaining the security of your account credentials and for all activity under your account. You may not transfer, sell, assign, or license your account to any other person.
Export Compliance: You represent that you are not prohibited from using the Services under U.S. export control and sanctions laws.
SECTION 2 - OUR PRODUCTS
We make every effort to represent our products accurately. However, product colors and appearance may vary from what you see on your screen due to device and display settings.
Made-to-Order: Many products are produced on demand. Once an order enters production, modifications or cancellations may not be possible.
We do not guarantee that products will meet your expectations or exactly match images shown online. All descriptions, pricing, and availability are subject to change at our discretion. We may discontinue or limit products at any time and may restrict quantities by person, household, or region.
SECTION 3 - ORDERS
When you place an order, you are making an offer to purchase. Orders are accepted only once payment has been processed and confirmed by us. We may accept or decline any order at our discretion.
We may limit or cancel quantities per person, household, or order, including those that appear placed by dealers, resellers, or distributors. If we decline or adjust an order, we will attempt to notify you at the contact details provided.
Your purchases are subject to our Shipping & Returns Policy. Refunds are only issued for defective, damaged, or incorrect items. Size exchanges are allowed but are not refundable.
You represent that your purchases are for personal or household use and not for commercial resale or export.
SECTION 4 - PRICES AND BILLING
Prices, discounts, and promotions may change without notice. The price charged is the one in effect at the time of order, listed in your confirmation email. Unless stated otherwise, posted prices exclude taxes, shipping, handling, customs, or import charges.
Pricing Errors: If a product is listed at an incorrect price or with incorrect information, we reserve the right to cancel orders and refund any payments, or contact you for instructions before processing.
You agree to provide current, accurate purchase and payment information, including billing details and expiration dates, so we can complete your transactions.
You represent and warrant that:
- The payment details you provide are valid and authorized.
- You are authorized to use the payment method.
- All charges incurred will be honored by your payment provider.
SECTION 5 - SHIPPING AND DELIVERY
All delivery times are estimates and not guarantees. We are not responsible for delays caused by carriers, customs, or events outside our control. Once we transfer products to the carrier, title and risk of loss pass to you.
Refunds are only available as described in our Refund Policy. Delivery delays alone do not create refund eligibility.
SECTION 6 - INTELLECTUAL PROPERTY
The Services—including trademarks, logos, text, graphics, product designs, photos, videos, and their arrangement—are owned by Iconic Climbs, Coastal Design Collective LLC, or our licensors, and are protected under U.S. and international laws.
You may use the Services only for personal, non-commercial purposes. No material may be copied, distributed, modified, or reproduced without our prior written consent.
Iconic Climbs’ name, logos, and designs are trademarks of Coastal Design Collective LLC. Shopify’s names and marks are trademarks of Shopify. Other marks belong to their respective owners.
Copyright Complaints: If you believe material infringes your rights, contact support@iconicclimbs.com with: (a) your contact details, (b) identification of the copyrighted work, (c) the URL(s) of infringing material, (d) a statement of good faith belief, and (e) your signature.
SECTION 7 - OPTIONAL TOOLS
You may access third-party tools through the Services. These are provided “as is” without warranties. Your use of them is at your own risk and subject to the provider’s terms.
SECTION 8 - THIRD-PARTY LINKS
Our Services may include links to third-party sites. We are not responsible for the accuracy or content of those sites and are not liable for any harm or damages from your use of them. Please review their terms and policies before engaging with them.
SECTION 9 - RELATIONSHIP WITH SHOPIFY
The Services are powered by Shopify. However, all purchases are between you and Iconic Climbs. By using the Services, you release Shopify from liability for your transactions with us.
SECTION 10 - PRIVACY POLICY
Your use of the Services is also governed by our Privacy Policy. Because the Services are hosted by Shopify, some of your data is also collected and processed by Shopify (shopify.com/legal/privacy). See both policies for details.
SECTION 11 - FEEDBACK
If you submit reviews, suggestions, or content (“Feedback”), you grant us a perpetual, royalty-free license to use, reproduce, publish, or display it for any purpose, including marketing. This includes use of your name, handle, and photos/videos in connection with your Feedback.
You are solely responsible for your Feedback and must have the necessary rights to share it. We may remove unlawful or offensive Feedback at our discretion.
SECTION 12 - ERRORS, INACCURACIES AND OMISSIONS
From time to time, information on our Services may contain errors or inaccuracies (e.g., product descriptions, pricing, promotions, shipping estimates). We reserve the right to correct these without notice, including after orders have been placed.
SECTION 13 - PROHIBITED USES
You may not use the Services for unlawful, harmful, or abusive purposes, or to interfere with others’ enjoyment of the Services. Prohibited uses include, but are not limited to: fraud, harassment, IP infringement, spamming, scraping, spreading malware, or bypassing security.
We may suspend or terminate accounts that violate these Terms.
SECTION 14 - TERMINATION
We may terminate your access to the Services at any time, with or without cause. You remain responsible for all charges through the termination date. Sections relating to IP, liability, warranties, indemnification, governing law, and other surviving provisions remain in effect.
Force Majeure: We are not liable for delays or failures caused by events beyond our control, such as natural disasters, labor disputes, supply chain disruptions, or carrier interruptions.
SECTION 15 - DISCLAIMER OF WARRANTIES
The Services and products are provided “as is” and “as available” without warranties of any kind, whether express or implied. We do not guarantee that the Services will be uninterrupted, secure, or error-free.
Some jurisdictions may not allow certain disclaimers; in those cases, the disclaimer applies only to the extent permitted.
SECTION 16 - LIMITATION OF LIABILITY
To the fullest extent permitted by law, Iconic Climbs, Coastal Design Collective LLC, and our affiliates, officers, employees, partners, and service providers shall not be liable for indirect, incidental, punitive, or consequential damages, including lost profits, revenue, data, or savings.
Our maximum liability to you shall not exceed the amount you paid for the product or service giving rise to the claim.
This does not limit liability for gross negligence, willful misconduct, or any liability that cannot be limited under law.
SECTION 17 - INDEMNIFICATION
You agree to indemnify and hold harmless Iconic Climbs, Coastal Design Collective LLC, Shopify, and their affiliates, officers, employees, and partners from claims, damages, and expenses (including legal fees) arising from your breach of these Terms or your misuse of the Services.
SECTION 18 - SEVERABILITY
If any provision of these Terms is held unlawful or unenforceable, the remainder shall remain valid and enforceable.
SECTION 19 - WAIVER; ENTIRE AGREEMENT
Failure to enforce any provision shall not waive that provision. These Terms, together with referenced policies, are the entire agreement between you and Iconic Climbs, superseding prior agreements.
SECTION 20 - ASSIGNMENT
You may not assign your rights under these Terms without our written consent. We may assign or transfer these Terms without notice.
SECTION 21 - GOVERNING LAW
These Terms are governed by the laws of the State of California. You agree to the exclusive jurisdiction of the state and federal courts located in Santa Barbara County, California.

Headings are for convenience only and do not affect interpretation.
SECTION 23 – THIRD-PARTY OR SELECTIVE PARTNERS PRODUCTS
Some products offered through our website are fulfilled directly by our trusted U.S. partner brands through our Selective Partners program, powered by Shopify Collective. When you purchase these items, you authorize Iconic Climbs to share the necessary order and shipping details with the partner brand to complete fulfillment.
Each partner brand is solely responsible for the production, quality, and delivery of their products. Iconic Climbs does not manufacture, inspect, or warrant items fulfilled by third parties and is not liable for any damages, defects, or delays related to these products.
Any questions or claims regarding a partner product should be directed to the brand listed as the seller on the product page or order confirmation.
SECTION 24 - CHANGES TO TERMS OF SERVICE
We may update these Terms at any time by posting a revised version with a new “Last updated” date. Material changes will be communicated as required by law. Continued use of the Services after changes constitutes acceptance.
